Le droit est traditionnellement lié à la pratique du commandement et de la hiérarchie. Il semble qu’une règle juridique établisse une immédiate relation entre une norme supérieure et une norme inférieure. La conception hiérarchique et impérative peut néanmoins être remise en cause dès lors que la phénoménologie de la règle juridique est appréhendée d’un point de vue interne, celui de ceux que l’on peut considérer comme les « utilisateurs » de la règle plutôt que ceux qui la subissent. Une approche (...) tournée vers la pratique pourrait, de cette façon, conduire à une théorie du droit plus ouverte et, d’une certaine façon, moins idéologique ou sectaire. C’est – comme le défend cet article – le programme ou mieux la promesse que l’on trouve dans l’ouvrage principal de Hart, le Concept de droit. Cet article tente de rendre cette promesse plus transparente sans toutefois dissimuler les difficultés de sa stratégie narrative et argumentative. (shrink)

A reflection on the philosophical traditions at the Autonomous University of Nuevo Leon and in the city of Monterrey.

Law is traditionally related to the practice of command and hierarchy. It seems that a legal rule should immediately establish a relation between a superior and an inferior. This hierarchical and authoritharian view might however be challenged once the phenomenology of the rule is considered from the internal point of view, that is, from the stance of those that can be said to “use” rather than to “suffer” the rules themselves. A practice oriented approach could in this way open up (...) a more liberal, and also somehow less parochial and ideological, road for legal theory. This is – it is argued in the paper – the programme, or better, the promise we can find in Herbert Hart’s main work, The Concept of Law. The article tries to render this promise more transparent while, nonetheless, not eschewing the blind sides of its narrative and argumentative strategy. (shrink)

A famous programmatic phrase from the Soliloquia shows how the young Augustine, in his thirties, had a clear idea of what one had to investigate in order to attain a knowledge of God: “Deum et animam scire cupio”. Here, Augustine established a link between two objects of research. Starting from this relation, this article explores Augustine’s anthropological doctrine, and focuses on four images used by Augustine to illustrate the human condition: (1) the lamp (lucerna), symbolizing the man composed by a (...) body, which is the container, and by a soul enclosed in the body, which is the flame. (2) The knight (eques), where although it is the horse (equus) that gives the name to the compound and defines the characteristics of its rider, the term ‘eques’ does not in any way designate the horse. (3) The centaur (centaurus), which expresses the inseparable unity of the two natures but also their distinction. (4) The chariot (biga), which perfectly symbolizes the union between body and soul, by the horses, and introduces a reference to God, by the figure of the charioteer. (shrink)

Can a person from Latin America be a Catholic, or a feminist, or a democratic socialist in an authentic way? These identities come from Europe, and given the colonial history of Latin America, it seems reasonable to think that decolonizing the Latin American mind is a condition for its authenticity. Further, it seems reasonable to think that decolonization itself requires extirpating ideas and identities originating from the colonizers, especially those used to establish the colonial order. Thus, it seems that Latin (...) Americans cannot adopt such identities; authentic decolonization demands otherwise. In this paper I argue that the thought of twentieth century Mexican philosopher Jorge Portilla provides a persuasive account of the nature of authentic self-creation that allows for a kind of decolonization that makes it conceptually possible for Latin Americans to be Catholics, feminists, or democratic socialists in an authentic fashion. That is, authentic decolonization of the mind, I argue, need not involve a blanket rejection of identities originating from the colonizers; instead, it can be understood as a particular kind of authentic self-creation: one that is appropriately sensitive to the colonial history of the identities freely chosen by the agent. Many of the social deprivations of Mexico will be worsened due to the SARSCOV2 pandemic. Namely, the insufficient access to public health, lack of labor rights, and the unsuccessful government’s response to eradicate male violence against women. The historical unconcern in promoting a culture rooted in mutual aid and self-care has provoked many citizens are disconnected from their social and health rights. Thus, people’s inability to carry through one direction –stay home- is unfulfilled, in part, due to structural inequalities. I (...) affirm that effective liberty could be obtained by approving a Universal Basic Income from a feminist perspective. I conclude that the aftermath of COVID-19, which will define everyday life for a while, require the endorsement of such measure. Likewise, women as a class deserve protection from a feminist critical framework. (shrink)

El objetivo de este artı́culo es desarrollar un enfoque para la comprensión de las crisis sociales basado en la “tragedia de los comunes” (TDC), centrada principalmente en sus interpretaciones en la teorı́a de juegos. Al analizar las principales interpretaciones de la TDC, lo que se observa, en primer lugar, es una caracterización del ambiente idóneo para la crisis sociales y, en segundo lugar, la existencia de una lógica con los siguientes elementos: (1) Las decisiones de individuos en contextos de interacción (...) social; (2) La existencia de mecanismos polı́ticos; (3) La existencia de mecanismos sociales. Con estos elementos a la vista lo que sostengo es que contra la idea general de la TDC, los comunes pueden llevar a cabo medidas para enfrenar la crisis por sı́ mismo (en este caso el factor relevante para resolver el problema es la cooperación). Sin embargo esto se encuentra supeditado a factores que exceden a los modelos aquı́ considerados. Además, dada la naturaleza del problema, una idea que se deriva del análisis desarrollado en este artı́culo es que no siempre basta con establecer acuerdos cooperativos para resolver una crisis, ni que todo acuerdo siempre es la mejor opción. En economía, la investigación se divide en dos grandes metodologías: los modelos teórico-matemáticos y los estudios empíricos. Estudiando modelos teóricos y métodos empíricos ) se da cuenta de las limitaciones de ambos métodos. Se concluye que ninguno de estos puede generar explicaciones de cómo en realidad suceden las cosas, sino que solo de cómo posiblemente suceden. La razón es que ambos necesitan un enlace interpretativo que permita extrapolar desde su propio sistema hacia un sistema objetivo. Los modelos tienen dominio general (...) y pueden dar cuenta de mecanismos. Los RCTs, al contrario, son válidos internamente y están conectados al mundo real, pero su dominio es muy específico. Aunque ninguno logre responder preguntas amplias de un fenómeno de interés, pueden complementarse para generar extrapolaciones más confiables sobre un sistema objetivo. Sin embargo, esto solo podrá hacerse si se conocen bien los mecanismos y el contexto en que ocurre una evidencia. In Philosophy, it is well known that of the total faculty population, the proportion of women is significantly lower than men. This disproportion is odd for a discipline within the humanities; these numbers seem more compatible with what is found in STEM (Science, Technology, Engineering, Mathematics) careers. These proportions are in turn a product of the low female presence that exists from the previous levels of academic training in philosophy. What happens in the case of the philosophy student body? For (...) example, the report presented by BeeBee and Saul (2011), on women in philosophy in the United Kingdom, in the period 2008 and 2009, points out that in the first degrees of academic training, in the bachelor's degree, women occupy 45% of the student population, in the master's degree 38% and in the doctorate 35%. Thus, "it is notable that there is a reduction in the proportion of women from the bachelor's degree to the doctorate [...]. This has as a consequence that at the professional level women holding positions as professors represent only 19%" (BeeBee & Saul, 2011, p. 11). Recently, Torres González (2018), based on European Union studies, points out that in Spain, with respect to gender disparity in students, "the data yield as a result masculinized studies, where, contrary to what happens in the branch of the humanities to which it [philosophy] belongs, males outnumber females by 28 percentage points" (2018, p. 328). This disparity is reflected in philosophy at the professional level, "the indicators of vertical segregation show a reinforced glass ceiling, which presents one of the worst data of hierarchical discrimination in the university: the percentage of female professors in philosophy is 12% compared to 21% of female professors in higher education" (Idem). Although it is a fact that there are fewer women than men studying philosophy and, therefore, fewer women than men working professionally in this discipline, we do not yet have possible explanations for this phenomenon of gender disparity in the student body in philosophy. In some cases, even if the number of women entering the philosophy degree program is already low, the number of women graduating is even lower, which indicates that there is attrition along the way; the initial numbers of women entering the program tend to decrease by the time they graduate. Thus we come to the question that is the subject of this paper: What causes female students to drop out of the philosophy program? In this article we answer this question from the philosophy of science and supported by local empirical data, so we do not give a complete or even less exhaustive answer. We review two explanatory models that purport to answer the question of why there are fewer women in philosophy, both formatively and professionally. These are the Different Voices Model (DVM) and the Perfect Storm Model (PSM); we opt for the latter and give reasons for it. Regarding the empirical aspect of our research, our source of statistical data belongs to the undergraduate program in philosophy at the Facultad de Estudios Superiores Acatlán-UNAM, Mexico (FES Acatlán), obtained in the framework of the SWIP-Analytic Mexico workshops. Our analysis of these data shows that even when female students have better GPAs than male students and take fewer subjects while enrolled, female students graduate less than male students in the FES Acatlan degree program. In this chapter I will present, in a general way, Millikan's biosemantic theory of the phenomenon of intentionality. For this purpose, the text will take the following path. First, I will present the problem of intentionality and an overview of the dominant theories of intentional content during the twentieth century and part of the twenty-first century. Then, I will present a general version of Millikan's biosemantic theory, appearing in 1984, which will allow us to see what the relevance and originality (...) of his proposal consists in. Finally, in keeping with one of the central purposes of Las filósofas que nos formaron, I will share a brief interview that Millikan very kindly agreed to give for this publication, in which she tells us some non-theoretical aspects of her history as a philosopher. La réflexion sur l’éthique et la participation des jeunes et des enfants à l’aménagement com- porte au moins deux dimensions : d’une part, les justifications d’une telle participation ; d’autre part, les problèmes que la pratique participative fait émerger et face auxquels les cadres de réfé- rence conventionnels (non participatifs) ne sont pas toujours utiles. Le présent article aborde ces deux dimensions et explore leurs liens à la lumière de trois méthodes distinctes en matière de théorie morale, soit l’éthique déontologique, (...) l’éthique conséquentialiste et l’éthique de la vertu. Sur la base d’une expérience participative d’aménagement inscrite dans le programme Grandir en Ville de l’UNESCO, certaines contradictions entre les principes d’une pratique participative avec des enfants et la manière dont les problèmes éthiques sont parfois gérés sont mises en évidence. Si se identifica libertad con voluntad, se corre el riesgo de tomar a la primera como el único aspecto en que la voluntad se desenvuelve, es decir, considerar el querer como mera actualización de la libertad. Pero la libertad no es más que un aspecto parcial de la voluntad, un aspecto cualitativo del querer, pues el dinamismo de la voluntad procede de su naturaleza y no del hecho de la libertad del acto del querer. La relación entre la inteligencia y (...) la voluntad es lo que caracteriza al acto específicamente humano. Por ello, se impone el análisis de la reciprocidad de influencia de las dos facultades espirituales en su propia unidad viva y funcional, pues si bien el libre albedrío se identifica con el momento de la elección, la libertad recorre todo el acto humano. Puesto que la voluntad tiende naturalmente a lo que supone perfeccionamiento del hombre, la libertad debe fomentar en el caso concreto esa orientación natural de la voluntad, es decir, elevarla a la práctica en la realidad concreta. Que la libertad disponga de la posibilidad de obrar en contra o al margen de ella, es decir, de romper de alguna forma la orientación natural de la voluntad, violentándola y torciéndola, es un defecto y también una forma de esclavitud, pues el hombre cuando obra el mal peca actúa al margen de la razón, conduciéndose como si fuese movido por otro distinto de él mismo. La posibilidad de apartarse del bien no pertenece a la esencia y a la perfección de la libertad, pues ésta consiste en obrar según la razón, impulso propio de acuerdo con su naturaleza. Los dos planos o motivaciones determinantes en que se articula la voluntad, como son el querer natural y necesario y, además, el querer deliberado y libre, son imprescindibles para dar un enfoque correcto al problema de la libertad: pues lo importante es apreciar en la acción libre la parte que se debe a la naturaleza de la voluntad, dándose la libertad únicamente como posibilidad de poner por obra un acto volitivo de acuerdo o no con la orientación natural de aquélla. El interés de esta indagación se centra especialmente en la voluntad deliberada o amor electivo del Bien. Podrá comprobarse la armonía constitutiva que reina entre la intención del fin y la elección de los medios, tema central cuando se estudia la psicología y la filosofía moral de Santo Tomás de Aquino. Las siguientes páginas se deciden a favor de la distinción entre intención del fin -intentio finis- y elección de los medios -electio mediorum-, haciendo partícipe a la voluntad deliberada del último fin en concreto, es decir, de Dios, a través de la intención, salvando así el poder de autodeterminación de la voluntad hacia el fin último en concreto, con lo que se abren las puertas a la conducta moral del hombre. Santo Tomás enfoca el problema de la libertad sin excluir ninguno de los tres planos en los que se articula, como son el plano ontológico, el plano psicológico y el plano moral, ya que el hombre tiene el deber de realizar en cada momento el máximo de su libertad en orden al perfeccionamiento de su ser, en una costosa labor de autocreación y no de caprichosa elección. Así, pues, el mayor ejercicio de libertad humana está en decidirse por su último fin en concreto, es decir, por Dios, a través de una adecuada elección de medios y de una recta intención, pues el hombre, en tanto que criatura, procede de Dios, y en tanto que hombre, tiene su fin último en la glorificación de Dios, en un doble ritmo de procesión y de retorno, poniéndose así de manifiesto el carácter religioso de la moral. Es por ello que el problema de la libertad es, en último término, un problema metafísico, que consiste en el movimiento natural y deliberado de la persona humana hacia su plenitud. (shrink)

En urbanisme, l’approche phénoménologique permet de se pencher sur l’expérience de l’individu et, plus précisément, sur le rapport que celui-ci entretient avec son milieu de vie. Cette approche permet de concevoir des milieux de vie mieux adaptés aux besoins et aux expectatives des individus et suppose des démarches d’aménagement qui accordent un rôle important au citoyen. Toutefois, si l’approche phénoménologique est couramment utilisée dans le cadre de travaux théoriques, elle est difficilement adoptée sur le terrain, en dépit de son utilité (...) et des justifications que l’on peut donner à son utilisation au plan éthique. Dans le présent article, nous explorons les raisons d’une telle disparité en levant le voile sur une double difficulté : difficulté professionnelle, d’une part, à dépasser le modèle déterministe du rapport personne–environnement ; diffi- culté scientifique, d’autre part, à ancrer la production de connaissances dans les processus de transformation du milieu de vie. La tesis aborda uno de los temas centrales en la filosofía de la mente y las ciencias cognitivas: los conceptos como unidades básicas de la cognición humana. La tesis central que se defiende es que el contenido de los conceptos es determinado parcialmente por las comunidades a las que pertenecen los sujetos cognitivos, en la medida en la que dichas comunidades guían y constriñen las interacciones entre el sistema cognitivo conceptual y el entorno del que forma conceptos. La novedad de (...) la tesis es doble. Por una parte, cuestiona las teorías dominantes sobre el contenido de los conceptos —las teorías descriptivistas y las teorías naturalistas—, no solamente a partir de desafíos filosóficos que muestran sus limitaciones, sino también a partir de evidencia empírica sobre el efecto de las interacciones sociales en el contenido de los conceptos y, por tanto, en la cognición. Por otra parte, proporciona evidencia empírica sobre infantes ferales (i.e. niños salvajes), cuyo sistema cognitivo conceptual no ha recibido la guía de ninguna comunidad humana en sus interacciones con el entorno. Dicha evidencia permite sugerir que una explicación puramente naturalizada del contenido, sin la presencia de las comunidades, no puede explicar el desarrollo cognitivo conceptual de dichos infantes. Así, la tesis logra proponer un papel no trivial de las comunidades en el debate sobre la determinación del contenido semántico de los conceptos. (shrink)

Understanding the ethical concerns of paid and altruistic surrogacy requires a knowledge of reproductive freedom and procreative autonomy. An accurate approach must be sensitive enough of the nature of sexual oppression, specifically in its influence in women’s choices, self-identity and personal relationships. The aim of this essay is to stand up for the prominence of radical feminism in questioning reproductive liberalism, which overfocus the interests of the so-called intended parents. Having in mind what egalitarian philosophers have put forward from a (...) social-relational autonomy view to allow surrogacy contracts under certain circumstances —particularly, they suggest that legalization could be compatible with women’s reproductive autonomy following an altruistic fashion under protective measures and supportive to the surrogate’s revocation of consent—, I uphold that radical feminists properly make clear how oppression remains in the cultural environment that endorses surrogacy contracts. A macroscopic methodology, based on American philosopher’s Marilyn Frye metaphor of the caged bird, is a helpful tool to comprehend why surrogacy contracts do not enhance women’s reproductive autonomy, even if they enable some surrogate mothers to gain an income enough to endure tough economic pressure. Las corrientes intelectuales e ideológicas posthumanistas abogan por la superación de diferentes límites biológicos de la especie humana. La ruptura incluye los asuntos reproductivos, como estrategias para la supervivencia y como cuidado de una dignidad posthumana. En este trabajo, quiero esbozar cuestiones del trans y posthumanismo reproductivo interesado en la gestación subrogada (GS) en sus diferentes modalidades. La GS es relevante para reconducir la reproducción siguiendo criterios promotores de la elección individual. Comienzo subrayando la herencia liberal en el movimiento por (...) la mejora humana y la elección procreativa. Después, sugiero que el posthumanismo reproductivo se apoya en los estudios de género y en la permisividad del comercio sexual para redefinir la GS como probable reproducción posthumana. Así, los objetivos del posthumanismo reproductivo ambicionan una agenda distinta a la feminista. Las perspectivas posthumanas y feministas proponen horizontes de justicia reproductiva que deberán criticarse en contexto antes de que los estados-nación procedan con reformas. (shrink)

El desarrollo del pensamiento crítico en la educación superior se inscribe en un contexto de transición de paradigmas. El paso de la modernidad a la postmodernidad y lo que esto significa en términos de modificación de parámetros de comprensión, de transformaciones en los ámbitos político, económico, social y cultural genera cambios en el sujeto. Desde experiencia docente se hace evidente la ausencia de pensamiento crítico en los estudiantes de los primeros niveles de educación superior, y por ello, la necesidad de (...) implementaciones didácticas innovadoras en el proceso de enseñanza. El presente documento tiene como objetivo presentar los aportes de la didáctica al desarrollo del pensamiento crítico en estudiantes de educación superior. Se trata de una revisión de tipo exploratoria-descriptiva; de carácter bibliográfico y con enfoque cualitativo. Se concluye que, la didáctica permite a los docentes orientar de manera consciente y creativa el proceso de enseñanza aprendizaje, ya que, al ser selectivos en los distintos métodos y técnicas aplicados en el proceso educativo contribuyen para potenciar el desarrollo del pensamiento crítico y para el desarrollo de capacidades cognoscitivas, sociales y afectivas integradoras de análisis, puntos de vista, problemas, decisiones y posturas que permiten en mejor desenvolvimiento del sujeto en el contexto. En la generación de daños ambientales los derechos individuales y colectivos pueden verse vulnerados, cuando se trata de comunidades indígenas, tribales y afrocolombianas, por la forma en la que estas conciben la naturaleza y la íntima relación que existe entre el ambiente y sus planes de vida. Por lo tanto, ante la presencia de daños en el ambiente de estas comunidades puede generarse de forma desencadenante un daño cultural, porque estas poblaciones son las que pierden el escenario raigal y ancestral (...) en el que desarrollan sus prácticas de identidad cultural. Precisamente, en el presente texto se pretende discernir si ante la presencia de un conflicto ambiental en el Arroyo de San Basilio de Palenque, que a su vez es centro de las relaciones socioeconómicas, culturales y lúdicas de los miembros de esta comunidad, se logra desencadenar un daño cultural. Reconstruying historically the beginning of development scientific thought in Venezuela, particularly in Physics, allow to account imperative need to preserve academic-scientific formation of Venezuelan society in 21st century. The Venezuelan historians Rafael Balza and Yajaira Freites in their respectively studies "Modern Physics in the Caraqueña Society of the late eighteenth century: between Mathematics and technique and "The problem of knowledge between hacendados and illustrated merchants of the province of Caracas-Venezuela (1793-1810)" allow to account efforts of Agustín de la Torre (...) to insert, in Venezuelan society of 18th century, teaching , research, divulgation and application of modern physical sciences initiated in Europe, marking the beginning of development of eighteenth-century Venezuelan technical and scientific thought. It should be noted that historical study of Agustín de la Torre is a complicated due to scarce documentation and cultural complexity of eighteenth-century Venezuela. The contribution of study is to account for risk of loss of Science in Venezuela in XXI century, through historical reconstruction around of Agustín de la Torre and his countless and tireless efforts to develop the study and application of physics experimental in Venezuela. The scope of this research is framed in the need to show the importance in the preservation of scientific talent. Studying the efforts in eighteenth-century Venezuela allows this. The historical study around Agustín de la Torre gives an account of the origin in the studies of physics and the complex situation within the scientific and social context to develop Science in Venezuela. Ensayistas y políticos que, a pesar de pertenecer y provenir a diferentes tradiciones intelectuales y de poseer ideas políticas contrarias, desarrollaron una reflexión (...) general sobre el vínculo entre saber y acción política e invocaron su relación a fin de establecer y garantizar un futuro autónomo y emancipado para el Perú. Asimismo, es magíster en Educación con mención en Políticas y Gestión de la Educación por la Universidad de San Martín de Porres (Lima, Perú). De se attitudes seem to play a special role in action and cognition. This raises a challenge to the traditional way in which mental attitudes have been understood. In this chapter, we review the case for thinking that de se attitudes require special theoretical treatment and discuss various ways in which the traditional theory can be modified to accommodate de se attitudes.

We study imagination as reality-oriented mental simulation : the activity of simulating nonactual scenarios in one’s mind, to investigate what would happen if they were realized. Three connected questions concerning ROMS are: What is the logic, if there is one, of such an activity? How can we gain new knowledge via it? What is voluntary in it and what is not? We address them by building a list of core features of imagination as ROMS, drawing on research in cognitive psychology (...) and the philosophy of mind. We then provide a logic of imagination as ROMS which models such features, combining techniques from epistemic logic, action logic, and subject matter semantics. Our logic comprises a modal propositional language with non-monotonic imagination operators, a formal semantics, and an axiomatization. (shrink)

It is well known that systems of action deontic logic emerging from a standard analysis of permission in terms of possibility of doing an action without incurring in a violation of the law are subject to paradoxes. In general, paradoxes are acknowledged as such if we have intuitions telling us that things should be different. The aim of this paper is to introduce a paradox-free deontic action system by (i) identifying the basic intuitions leading to the emergence of the paradoxes (...) and (ii) exploiting these intuitions in order to develop a consistent deontic framework, where it can be shown why some phenomena seem to be paradoxical and why they are not so if interpreted in a correct way. Call ‘a substance’ a person who is at home in a relatively stable and unified sense-making framework: a social structure that to some degree specifies which categories are important for interpreting reality, which goals are worth pursing, which character traits are admirable, etc. Call ‘an accident’ a person who is not at home in one such framework. It is tempting to think that being a substance is preferable, but I present some considerations for thinking otherwise. Mexican philosophers Emilio Uranga and (...) Jorge Portilla, I argue, present notions of accidentality as decolonial tools. Uranga’s account enables Mexicans to have positive valuation of their being independently of the approving gaze of the colonizers and their standards of value. Portilla’s thought distinguishes between pernicious accidentality resulting from the disintegration of sense-making frameworks and authentic accidentality as a condition for freedom, self-creation, and ultimately for individual and communal liberation. Intentionality is traditionally defined as the property of a mental state to be directed at something presented in a particular way. The fact that we can think about objects which do not exist makes this definition problematic: what kind of things are those objects? The aim of this paper is to analyse the definition of intentionality as a relation in theories which do not admit non-existent special entities. In particular, I consider John R. Searle and Tim Crane’s theories of intentionality (...) and I argue that neither Searle’s notion of a non-ordinary relation between the intentional state and the intentional object nor Crane’s idea of a relation between the intentional state and the intentional content succeed in holding together the traditional definition of intentionality and the purpose to not be committed to some kind of special entities. This intent seems finally hardly compatible with the traditional definition of intentionality. (shrink)

Currently available systems of action deontic logic are not designed to model procedures to assess the conduct of an agent which take into account the intentions of the agent and the circumstances in which she is acting. Yet, procedures of this kind are essential to determine what counts as culpable not doing. In light of this, we design an action logic, AL, in which it is possible to distinguish actions that are objectively possible for an agent, viz. there are no (...) objective impediments for the agent to do them, and actions that, besides being objectively possible, are compatible with the setting or intentions of the agent. The aim of this paper is to introduce a system of dynamic deontic logic in which the main problems related to the de finition of deontic concepts, especially those emerging from a standard analysis of permission in terms of possibility of doing an action without incurring in a violation of the law, are solved. The basic idea is to introduce two crucial distinctions allowing us to differentiate (i) what is ideal with respect to a given code, which fixes the types (...) of action that are abstractly prescribed, and what is ideal with respect to the specific situation in which the agent acts, and (ii) the transitions associated with actions and the results of actions, which can obtain even without the action being performed. Leibniz claims that for every possible substance S there is an individual concept that includes predicates describing everything that will ever happen to S, if S existed. Many commentators have thought that this leads Leibniz to think that all properties are had essentially, and thus that it is not metaphysically possible for substances to be otherwise than the way their individual concept has them as being. I argue against this common way of reading Leibniz’s views on the metaphysics of modality. (...) I develop a model in which individual concepts are innocent; that is, individual concepts are divine ideas that permit God to know everything that will ever happen to all possible substances, if created, but these individual concepts neither require that all properties are had essentially nor require that it is metaphysically necessary for substances to be the way their individual concepts have them as being. I argue for a substantive interpretation of Carlos Vaz Ferreira’s account of intellectual flourishing as intellectual liberation. For Vaz Ferreira, I argue, there is an inescapable master-slave dynamic between language and language users, so that flourishing intellectually essentially involves a type of mastery of language that frees up thinking from enslaving linguistic/conceptual confusions and thus facilitates the acquisition of truth. Central to this project are Vaz Ferreira’s most interesting, and radical, views on the nature of language signification and thus on (...) human’s ability to accurately describe and know reality, for failing to keep these linguistic limitations in mind, Vaz Ferreira argues, is a central way for language to enslave humans to confused thinking and thus prevent their intellectual flourishing. Los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República deben realizar, como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que ese conocimiento termine olvidado en los fondos de la biblioteca de la (...) Facultad, entre cientos de producciones monográficas. Se pretende en este libro, mostrar los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales. Varias de las monografías fueron realizadas en la línea de investigación Costos y Gestión de Organizaciones Culturales, la cual coordino. Otros fueron realizados con antelación, como los trabajos tutorados por el referente de la Economía de la Cultura en Uruguay, el hoy fallecido Luis Stolovich. También se incluyen dos trabajos monográficos tutorados por el Dr Gustavo Buquet, quien siempre está presente a la hora de crear investigación de calidad en Economía de la Cultura. Como cada trabajo supera el centenar de páginas, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de esos trabajos, intentando adecuar la terminología y quitándoles el formato estrictamente científico –poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. Se resumieron ocho, clasificados en tres capítulos: Patrimonio, Artes Escénicas e Industria Cultural. El capítulo de Patrimonio comienza con un trabajo realizado por las Economistas Fernanda Arezo y Verónica Pereyra, titulado “Museos y Ciudadanos, el comportamiento del consumidor”, tutorado por Raúl Ramírez y por mí. Este estudio tuvo como centro explicar la modalidad de conducta de consumo del visitante montevideano hacia tres importantes instituciones museísticas como lo son el Museo del Cabildo, el Museo del Carnaval y el Museo de Historia del Arte. El objetivo del trabajo es estimar la demanda y obtener un indicador de la propensión a pagar por el consumo de dichos museos. El segundo trabajo, titulado “Disposición a pagar por la restauración de la Puerta de la Ciudadela”, fue realizado por las Contadoras Beatriz Torres, María Elena Olarán y María Carolina Duarte, y tutorado en forma conjunta por el Phd. Juan José Goyeneche y quien les escribe. En este trabajo se realiza una valoración contingente para medir la disposición a pagar por la restauración de la “Puerta de la Ciudadela”, un monumento fundamental de identidad montevideana. El capítulo de Patrimonio finaliza con un trabajo realizado por las Economistas Malena Rodríguez y María de la Paz Besada y tutorado por el Ec. Luis Stolovich. El mismo se denomina “El arte uruguayo: un estudio sobre el mercado y la pintura como alternativa de inversión” y explora el mercado de arte uruguayo, analizando la rentabilidad de la inversión en pintura uruguaya. Tratan la rentabilidad de la inversión para tres casos específicos: las obras vendidas por el Banco Comercial en su proceso de recuperación de activos, un portafolio de obras de Pedro Figari y otro de Joaquín Torres García. En cuanto al segundo capítulo, Artes Escénicas, comienza con un trabajo realizado para la obtención del título de Contador Público realizado por Pamela Cambeiro, Martín Cami e Ignacio Mouradián. Se denomina “La gestión de teatros. Caso de estudio: Aplicación del Cuadro de Mando Integral al Teatro Solís” y trata sobre la identificación de indicadores que faciliten las tareas de gestión para la dirección del Teatro. Luego se presenta un trabajo realizado por las Economistas Tania Cruz y Natalia Nollenberger titulado “Análisis económico del teatro independiente en Montevideo: una aproximación al problema de la fatalidad de los costos”. Este trabajo, también tutorado por el Ec. Luis Stolovich, muestra un exhaustivo análisis del teatro independiente montevideano identificando los problemas económicos que afectan al sector. El capítulo de Industria Cultural incluye tres trabajos. El primero, fue realizado por el Economista Diego Traverso y tutorado por el Dr. Gustavo Buquet, y su título es “Análisis de competitividad del sector exportador de Productoras Audiovisuales Publicitarias en Uruguay”. El sector audiovisual publicitario es un sector dinámico que se ha internacionalizado tempranamente y que generó divisas para el país del orden de los US$ 24 millones durante el año 2005 por concepto de exportaciones. En este trabajo se caracteriza al sector audiovisual publicitario en Uruguay y se analiza las ventajas competitivas que posee frente a sus principales competidores extranjeros. El segundo trabajo fue realizado por las Contadoras Natalia Rivera, Antonella Triay y María Eugenia Triay y se denomina “Gestión aplicada a las empresas radiales”. En este se identifican el sector radial, su proceso productivo y la complejidad al definir al “cliente”. Se proponen una serie de indicadores con el doble objetivo de medir el desempeño de la empresa y proveer incentivos a su organización. Finalmente, el último trabajo monográfico, fue una investigación interdisciplinaria, que sirvió simultáneamente para obtener el título de Licenciado en Economía a Ernesto Pienika y el de Licenciado en Administración a Nicolás Cohnheim y a Damián Geinsinger. Este trabajo, tutorado por el Dr. Gustavo Buquet y el Cr. Cecilio García de título “Impactos de las nuevas tecnologías en la .industria musical”, muestra cuáles son los principales impactos en esa industria que las nuevas tecnologías han provocado y cuáles son las posibles estrategias para adaptarse a estos cambios, así como los nuevos modelos de negocio. Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida. (shrink)

Based on Maldonado-Torres’s formulation of the term, we conceive the decolonial turn as a form of liberating and decolonising reason beyond the liberal and Enlightened emancipation of rationality, and beyond the more radical Euro-critiques that have failed to consistently challenge the legacies of Eurocentrism and white male heteronormativity (often Eurocentric critiques of Eurocentrism). We complement Maldonado-Torres’s account of the decolonial turn in philosophy, theory and critique by providing an analysis of the trajectories of academic philosophy and clarifying the relevance of (...) decolonising philosophy and of the decolonial turn for current efforts in transforming philosophy in face of the challenges of social movements such as the Third World Liberation Front and Black Lives Matter in the United States, and Rhodes Must Fall in South Africa and England. After a brief analysis of the trajectory and current status of philosophy as a discipline in the modern Western research university, we provide examples of the decolonial turn and of decolonising philosophy in three areas: the engagement with (1) Asian and (2) Latin American philosophies, and (3) debates in the philosophy of race and gender. In the following paper, I wish to examine a problem for the theist libertarian. On the one hand, libertarians insist that freedom requires possible alternatives open to the agent. On the other hand, God’s perfectly formed moral character implies that He always does the morally best. Give His moral character, then, it appears that there are no possible alternatives open to God. We thus get a dilemma for the theist libertarian: either a) God is not libertarian free – because His (...) moral character rules out possible alternatives; or b) God’s character is not perfectly formed – because libertarian freedom requires that it is possible for God to act out of character. In the present paper, I argue that Thomas Reid, a paradigmatic libertarian, has the theoretical tools to retain a robust account of libertarian freedom without compromising a robust account of perfectly formed characters. In sum, it is necessary that agents with fully formed characters always act in character (read de dicto), but it is possible that agents with fully formed characters act out of character (read de re). The former claim captures the robustness of perfectly formed moral characters and the latter claim captures the robustness of libertarian freedom. (shrink)

Inspired by Castañeda (1966, 1968), Perry (1979) and Lewis (1979) showed that a specific variety of singular thoughts, thoughts about oneself “as oneself” – de se thoughts, as Lewis called them – raise special issues, and they advanced rival accounts. Their suggestive examples raise the problem of de se thought – to wit, how to characterize it so as to give an accurate account of the data, tracing its relations to singular thoughts in general. After rehearsing the main tenets of (...) two contrasting accounts – a Lewisian one and a Perrian one – in the first section of this paper, in the second I will present a proposal of my own, which is a specific elaboration of the Perrian account. In the first section I will indicate some weaknesses of Perry’s presentation of his view; the proposal I will articulate in the second overcomes them. I will conclude with a brief discussion of reasons for preferring one or another account, in particular regarding the issue of the communication of de se thoughts. (shrink)

No two individuals with the autism diagnosis are ever the same—yet many practitioners and parents can recognize signs of ASD very rapidly with the naked eye. What, then, is this phenotype of autism that shows itself across such distinct clinical presentations and heterogeneous developments? The “signs” seem notoriously slippery and resistant to the behavioral threshold categories that make up current assessment tools. Part of the problem is that cognitive and behavioral “abilities” typically are theorized as high-level disembodied and modular functions—that (...) are assessed discretely (impaired, normal, enhanced) to define a spectral syndrome. Even as biology reminds us that organic developing bodies are not made up of independent switches, we remain often seduced by the simplicity of mechanistic and cognitive models. Developmental disorders such as autism have accordingly been theorized as due to different modular dysfunctions—typically of cortical origin, i.e., failures of “theory of mind” (Baron-Cohen et al., 1985), of the “mirror neuron system” (Ramachandran and Oberman, 2006), of “weak central coherence” (Happe and Frith, 2006) or of the balance of “empathizing” and “systemizing” (Baron-Cohen, 2009), just to list a few. -/- The broad array of autonomic (Ming et al., 2005; Cheshire, 2012) and sensorimotor (Damasio and Maurer, 1978; Maurer and Damasio, 1982; Donnellan and Leary, 1995; Leary and Hill, 1996; Donnellan and Leary, 2012; Donnellan et al., 2012) differences experienced and reported by people with autism have by such theories typically been sidelined as “co-morbidities,” possibly sharing genetic causes, but rendered as incidental and decisively behaviorally irrelevant symptoms—surely disconnected from cognition. But what if the development of cortically based mental processes and autonomous control relies on the complexities and proper function of the peripheral nervous systems? Through such an “embodied” lens the heterogeneous symptoms of autism invites new interpretations. We propose here that many behavioral-level findings can be re-defined as downstream effects of how developing nervous systems attempt to cope and adapt to the challenges of having various noisy, unpredictable, and unreliable peripheral inputs. I suggest a way of extending Stalnaker’s account of assertion to allow for centered content. In formulating his account, Stalnaker takes the content of assertion to be uncentered propositions: entities that are evaluated for truth at a possible world. I argue that the content of assertion is sometimes centered: the content is evaluated for truth at something within a possible world. I consider Andy Egan’s proposal for extending Stalnaker’s account to allow for assertions with centered content. I argue that Egan’s (...) account does not succeed. Instead, I propose an account on which the contents of assertion are identified with sets of multi-centered worlds. I argue that such a view not only provides a plausible account of how assertions can have centered content, but also preserves Stalnaker’s original insight that successful assertion involves the reduction of shared possibilities. This work aims to spell out clear the tensions manifested by the meeting between the project of a reflexive philosophy and psychoanalysis, from a very specific event: the publication, in 1965, of the thesis De l'interprétation: essai sur Freud by Paul Ricoeur. Our question arises from the fact that psychoanalysis has introduced one of the greatest embarrassments to the philosophies of consciousness, as it established the unconscious psychic as foundation and array of subjectivity. In contrast, Paul Ricoeur strengthens its belonging (...) to the reflective tradition initiated by Husserl, but with a fundamental deviation: in your access to subjectivity, this reflexive philosophy must take the form of a hermeneutics that interprets the signs of man’s existence. Given this, the present study seeks to find out what difficulties, tensions and contributions the reading of Freud offers to hermeneutic project proposed by Ricoeur. The article aims to show how the philosophical reading of Freud allowed Ricoeur to arbitrate the different and sometimes conflicting hermeneutics approaches around the problem of symbol. (shrink)

There is currently disagreement about whether the phenomenon of first-person, or de se, thought motivates a move towards special kinds of contents. Some take the conclusion that traditional propositions are unable to serve as the content of de se belief to be old news, successfully argued for in a number of influential works several decades ago.1 Recently, some philosophers have challenged the view that there exist uniquely de se contents, claiming that most of the philosophical community has been under the (...) grip of an attractive but unmotivated myth.2 At the very least, this latter group has brought into question the arguments in favor of positing special kinds of content for de se belief; I think they have successfully shown that these arguments are not as conclusive, or fully articulated, as many have taken them to be. In this paper I will address these challenges directly and I will present and defend an argument for the conclusion that the phenomenon of de se thought does indeed motivate the move to a special kind of content, content that is uniquely de se. First, I characterize a notion of de se belief that is neutral with respect to friends and foes of uniquely de se content. I then argue for a determination thesis relating de se belief to belief content: that there is no difference in de se belief without a difference in belief content. I argue that various proposals for rejecting this determination thesis are unsuccessful. In the last part of the paper, I employ this determination thesis to argue for the existence of a type of belief content that is uniquely de se. (shrink)

In recent years, the opioid crisis in the United States has sparked significant discussion on doctor–patient interactions concerning chronic pain treatments, but little to no attention has been given to investigating the vocal aspects of patient talk. This exploratory sociolinguistic study intends to fill this knowledge gap by employing prosodic discourse analysis to examine context-specific linguistic features used by the interlocutors of two distinct medical interactions. We found that patients employed both low pitch and creak as linguistic resources when describing (...) chronic pain, narrating symptoms and requesting opioids. The situational use of both features informs us about the linguistic ways in which patients frame fraught issues like chronic pain in light of the current opioid crisis. This study expands the breadth of phonetic analysis within the domain of discourse analysis, serving to illuminate discussions surrounding the illocutionary role of the lower vocal tract in expressing emotions. Autism has been defined as a disorder of social cognition, interaction and communication where ritualistic, repetitive behaviors are commonly observed. But how should we understand the behavioral and cognitive differences that have been the main focus of so much autism research? Can high-level cognitive processes and behaviors be identified as the core issues people with autism face, or do these characteristics perhaps often rather reflect individual attempts to cope with underlying physiological issues? Much research presented in this volume will point (...) to the latter possibility, i.e. that people on the autism spectrum cope with issues at much lower physiological levels pertaining not only to Central Nervous Systems (CNS) function, but also to peripheral and autonomic systems (PNS, ANS) (Torres, Brincker, et al. 2013). The question that we pursue in this chapter is what might be fruitful ways of gaining objective measures of the large-scale systemic and heterogeneous effects of early atypical neurodevelopment; how to track their evolution over time and how to identify critical changes along the continuum of human development and aging. We suggest that the study of movement variability—very broadly conceived as including all minute fluctuations in bodily rhythms and their rates of change over time (coined micro-movements (Figure 1A-B) (Torres, Brincker, et al. 2013))—offers a uniquely valuable and entirely objectively quantifiable lens to better assess, understand and track not only autism but cognitive development and degeneration in general. This chapter presents the rationale firstly behind this focus on micro-movements and secondly behind the choice of specific kinds of data collection and statistical metrics as tools of analysis (Figure 1C). In brief the proposal is that the micro-movements (defined in Part I – Chapter 1), obtained using various time scales applied to different physiological data-types (Figure 1), contain information about layered influences and temporal adaptations, transformations and integrations across anatomically semi-independent subsystems that crosstalk and interact. Further, the notion of sensorimotor re-afference is used to highlight the fact that these layered micro-motions are sensed and that this sensory feedback plays a crucial role in the generation and control of movements in the first place. In other words, the measurements of various motoric and rhythmic variations provide an access point not only to the “motor systems”, but also access to much broader central and peripheral sensorimotor and regulatory systems. Lastly, we posit that this new lens can also be used to capture influences from systems of multiple entry points or collaborative control and regulation, such as those that emerge during dyadic social interactions. What is the relationship between Frege’s puzzle and the puzzle of the de se? An increasingly influential view claims that the de se puzzle is merely an instance of Frege’s puzzle and that the idea that de se attitudes pose a distinctive theoretical challenge rests on a myth. Here we argue that this view is misguided. There are important differences between the two puzzles. First, unlike Frege puzzle cases, de se puzzle cases involve unshareable Fregean senses. Second, unlike Frege puzzle (...) cases, de se puzzle cases cannot be resolved by objective information alone. Further, there seem to be pure cases of each puzzle: instances of the de se puzzle which do not have a Fregean structure, and instances of Frege’s puzzle, which do not involve de se attitudes. We conclude that the two puzzles are fundamentally different and that the traditional theory of attitudes needs to be amended. (shrink)

Neuroenhancement involves the use of neurotechnologies to improve cognitive, affective or behavioural functioning, where these are not judged to be clinically impaired. Questions about enhancement have become one of the key topics of neuroethics over the past decade. The current study draws on in-depth public engagement activities in ten European countries giving a bottom-up perspective on the ethics and desirability of enhancement. This informed the design of an online contrastive vignette experiment that was administered to representative samples of 1000 respondents (...) in the ten countries and the United States. The experiment investigated how the gender of the protagonist, his or her level of performance, the efficacy of the enhancer and the mode of enhancement affected support for neuroenhancement in both educational and employment contexts. Of these, higher efficacy and lower performance were found to increase willingness to support enhancement. A series of commonly articulated claims about the individual and societal dimensions of neuroenhancement were derived from the public engagement activities. Underlying these claims, multivariate analysis identified two social values. The Societal/protective highlights counter normative consequences and opposes the use enhancers. The Individual/proactionary highlights opportunities and supports use. For most respondents these values are not mutually exclusive. This suggests that for many neuroenhancement is viewed simultaneously as a source of both promise and concern. (shrink)
